The final auction hammer indicates the winning bid for a work of art at auction. As spectators we understand this bid indicates a price for the work, but beyond the final bid, where else does the value of art reside? Art as a commodity is not easily translated into value as another commodity market can, such as automobiles, or even real estate. Beyond the monetary value lies an illusive value, the symbolic. Within an artwork, there are multiple forms of value prevalent: the symbolic, the monetary, and finally, the greater cultural value. Through a series of case studies that focus on three art law cases in France, the United States, and the Netherlands, this thesis examines how different countries morally and legally protect the value in art. Beyond these contrasting global presumptions, this thesis also examines the common denominator of all three case studies; why the value of art, in its different forms, is so difficult to assign, and in the end, how these forms of value last over time.
