China has set a national goal to advance itself from an "imitation-oriented country" to an "innovation-oriented country" by year 2020, and is aiming to rank top five in the world in the annual granted indigenous invention patents, in order to achieve this goal. The question is whether more patents mean more innovations, and whether China's current patent regime is appropriate for promoting innovation? This dissertation uses the interplay between patent and biotechnology and pharmaceutical industries in China as a case study to answer this question. The dissertation found that, compared with the developed countries, although fairly advanced in the selected areas, China's biotech and pharmaceutical industries as a whole still lags behind. A strong patent system is still indispensable for stimulating innovation in China. The problem of access to technology and medicine is not caused by patent system, but by the monopoly of multinational pharmaceutical companies and by the irregular and immature Chinese drug market. Other laws such as anti-trust law may be an answer to this problem. While it is important to balance interests between patent right protection and public welfare, transforming China from an "imitation-oriented country" to an "innovation-oriented country" should be the government's top priority. To accomplish this goal, patent law still has much room to improve and a greater role to play.
