The purpose of this research was to review Early Retirement Incentive Programs (ERIPs) administered in Kansas school districts to determine the extent to which these programs are in compliance with applicable state laws (Kansas Negotiations Act and Kansas Public Employees Retirement System Compensation Act) as well as federal law (Age Discrimination in Employment Act as amended by the Older Workers Benefit Protection Act). Early in this project an opinion was requested from the Kansas Attorney General regarding ERIPs. As a result of opinion No. 99-14, nearly 150 policies were found to be inconsistent with the permissive authority of Kansas law compelling a statutory amendment during the 1999 legislative session.

Through this research, existing school district ERIPs were collected and reviewed along with administered surveys. The policy review determined that 132 out of 159 districts (83%) with ERIPs (43% of all Kansas school districts) were inconsistent with the ADEA. The survey determined that 59 out of 63 districts (94%) that provide district-paid health insurance benefits for retirees (19% of all Kansas school districts) have plans that are inconsistent with the ADEA.

School districts in Kansas have the authority to negotiate teacher contracts for a length of time not to exceed three-years. However, it was determined that 131 of the 159 districts (82%) with ERIP policies (43% of all Kansas school districts) extend benefits beyond this limitation. It was further determined that 65 out of 94 districts (69%) that provide ERIP benefits to their superintendents (21% of all Kansas school districts) do not have contractual language to support this benefit.

A previous Kansas Attorney General's Opinion implied that ERIP benefits paid to retirees should be considered in the

5,000 earnings limitation established through statute. Surveys results determined that 13 teacher policies, 21 administrative policies, and 1 classified policy in Kansas schools potentially exceed this limitation. The state retirement system does not currently practice this Attorney General's interpretation.
