In this thesis I examine Thomas Middleton's The Phoenix (1603) and Ben Jonson's The Magnetic Lady (1632). First, I use the two plays to provide a historical overview of the wardship system and the particular legal constraints faced by women wards operating within this system. Then, I pivot to moments where the playwrights raise the stakes for the women wards Niece, Placentia, and Pleasance, by featuring moments that do not advance the plot, but rather serve to emphasize the restrictions placed on women wards. I suggest that Niece's enforced marriage, Placentia's pregnancy, and Pleasance's mistaken identity all work to subtly critique The Court of Wards and Liveries. Finally, I explore the solutions Middleton and Jonson offer to the wardship problem by analyzing how justice is restored for the wards within the text. In doing so, I maintain that Middleton and Jonson highlight the importance of non-familial male characters in protecting women wards and maintaining their inheritance. The two playwrights seemingly offer a form of communal surveillance as a means of maintaining the wardship system, but this form of surveillance can notably only be orchestrated within the text by males. Additionally, the plays were written twenty-nine years apart, and during this time The Court of Wards and Liveries had significant turnover in the court's office of Master. Given that the Court consistently failed at protecting wards, Middleton and Jonson significantly offer a way forward for readers, as the actions of Phoenix and Compass provide examples of enacting communal justice and intervening on the behalf of the ward.
