Using critical theory, an eclectic grouping of postmodern theories, this study demonstrates that scholarly discussions about male and female role symmetry/asymmetry in biblical laws and violence against women in these laws are related to each other. To show that relationship, this study proceeds in three phases. The first phase reveals that all of the laws of the Book of the Covenant and the Deuteronomic Law can be divided according to whether they treat men and women symmetrically (inclusive laws) or asymmetrically (exclusive laws). In the second phase, the argument is made that the inclusive laws construct identities that apply to both males and females, such as those of being an Israelite or a member of a privileged or nonprivileged class. Exclusive laws, though, construct the identity of gender which is defined as the oppositional behavioral patterns ascribed to males and females. In the third phase of the study, the construction of gender is explored more fully. Gender in these laws is found to be defined as male dominance/female subordination according to both contemporary gender theory and feminist legal theory. Then, based on the work of the Frankfurt School theorists, the gender paradigm of male dominance/female subordination is equated with violence. In current discussions on biblical laws, analyzing the treatment of women is thought to be synonymous with analyzing gender, and it is assumed that male and female roles are either asymmetrical or symmetrical. This study furthers these discussions by showing that not all laws concerning women construct gender and that women have symmetrical and asymmetrical roles simultaneously because these laws are both inclusive and exclusive. Most importantly, though, the study suggests that the exclusive laws, which construct gender as male dominance/female subordination, do not just describe violence against women but are inherently violent toward women. Critical theory then, as a nonhistorical, text-immanent critique of ideology, offers analytical insights that have significant implications for the interpretation of gender constructions in both ancient and contemporary settings.
