China's active engagement in the theft of U.S. intellectual property has become a growing challenge in U.S. strategic position globally. This dissertation highlights the consequences of China's rise on the U.S economic and strategic security initiatives. The research will highlight China's covert methods to acquire U.S. intellectual property using prosecuted cases. The research also provides recommended causes of action to prevent, protect and deter China from stealing U.S. intellectual property. Additionally, this research presents recommendations to U.S. policymakers to manage the rising China threat effectively. It emphasizes the need for interagency collaboration as crucial in achieving governmental objectives to better preserve U.S. intellectual property. This dissertation will demonstrate how such coordination is crucial, especially in fighting the challenges China currently poses to the U.S strategic position globally. The research demonstrates that the Chinese have been engaged in the theft of intellectual property for centuries. However, their means of acquiring IP have transformed dramatically in the sophistication of their methods. In recent decades, they have been actively engaged in using covert means to acquire U.S. intellectual property. To address the challenges posed by the theft of U.S. intellectual property, this research will employ examples of current and prosecuted cases to demonstrate that this is a challenge for the U.S. government. Thus, the U.S. must immediately address the implementation of new policies that will take a more active role in preventing Chinese government insiders from accessing relevant information.
