India is one of the 36 countries that has not abolished marital rape exemption and only offers civil remedies. This thesis aims to understand the seriousness of the unaddressed problem of sexual violence within marriage in India and identify potential factors associated with it. Using a cross-sectional study's secondary data from the National Family Health and Surveys 2015-16 India, I select a sample size of ever-married women (n= 4372) between 15 and 49. The primary outcome variable of experiencing any form of sexual violence by husband/partner within the past 12 months preceding the survey was determined. Explanatory variables were socio-demographic characteristics, the husband's controlling behaviors, the wife's attitudinal acceptance of physical spousal violence, and help-seeking behavior. Data analysis shows descriptive statistics and chi-square tests. This research indicates that married women in India were on a high end of experiencing sexual intimate partner violence; 82% reported experiencing some form of sexual violence at least once in the past 12 months before the survey. Forced non-consensual sexual intercourse was the highest reported form of sexual violence women faced. Chi-square analysis showed statistical associations with behaviors justifying wife abuse, women's employment, age, help-seeking behavior, and husband's controlling behavior. The risk and prevalence of sexual IPV are high in India. These results provide vital information to further look at policy development, keeping gender at the forefront, for reformed social and legal discourses, sensitize the authorities about violence against women, and include health care implications for providing better essential services to the survivors of IPV.
