The accelerated pace of commercialisation of outer space activities indicates a drastic proliferation in rocket launches when activities such as space tourism and asteroid mining become feasible. However, the environmental impact of rocket emissions fails to be adequately governed by international space law. This thesis examines the need to regulate rocket emissions and aims to establish founding principles that may be applied to a mechanism for the international space sector. Chapter 1 presents the environmental hazards posed by rocket emissions, in particular focusing on the relationship between emissions, ozone depletion and climate change. Chapter 2 then substantiates the necessity for new regulation by identifying how rocket emissions fall beyond the scope of the space treaties. This chapter also presents an overview of the UNFCCC framework and raises the issue of fragmentation in international environmental law. Chapter 3 then considers arguments in favour of and against a blanket tax and emissions trading scheme, to develop principles that may be applied to either form. Chapters 4 and 5 thereafter undertake comparative studies of emissions regulation in international air transport and international maritime transport respectively. Based on these two studies, the author proposes principles in Chapter 6 which could serve as the foundation of a mechanism on rocket emissions for the international space sector.

La viabilite des activites comme tourisme spatial et extraction d'asteroides peuvent engendrer une acceleration de la commercialisation des activites cosmiques. Cela peut causer une proliferation drastique des lancements de fusees. Toutefois, le droit international en espace ne parvient pas a reglementer l'impact environnementale de ces lancements de fusees. Cette these examine l'importance de reglementer des emissions de fusees. Elle vise a etablir les principes fondamentaux qui peuvent etre appliques dans un mecanisme de secteur spatial international. Le premier chapitre presente les hasards environnementaux engendres par les emissions de fusees. Particulierement, il se concentre sur la relation entre les emissions, la depletion de couche d'ozone et le changement climatique. Le deuxieme chapitre justifie la necessite des nouvelles reglementations en identifiant comment les emissions de fusees ne sont pas regies par les traites sur espace. De plus, ce chapitre presente un apercu de cadre de la CCNUCC et pose la problematique de fragmentation du droit international sur l'environnement. Le troisieme chapitre considere les arguments pour et contre une taxe forfaitaire et un systeme d'echange de droits d'emission, pour developper des principes qui peuvent etre appliques en ces cas. Les quatrieme et cinquieme chapitres entreprennent des etudes comparatives sur les reglementations d'emissions en transport aerien international et en transport maritime internationale. Basee sur ces etudes, l'auteur propose, dans le sixieme chapitre, les principes qui peuvent fonctionner comme la fondation d'une mecanisme sur les emissions de fusees dans le secteur international sur l'espace.
