International law has played a decisive role during the evolution of interstate natural resource sovereignty and governance. However, there is a call for the setting of international rules which govern the activities of the multinational companies in the host states due to cross-border investments and the mobility of capital across jurisdictions. In addition, the existence of legal, institutional and regulatory frameworks in the oil and gas industry in Tanzania without coordination and harmonisation accounts for the poor governance of the industry. The study aimed to examine the role of international law on intrastate natural resource governance, in particular, the extent to which it can help to improve governance challenges in the host states. Also, the study examined the legal, institutional and regulatory pitfalls in the oil and gas industry in Tanzania and the means by which they can be improved to enhance extraction of oil and gas resources in an environmentally friendly manner for the sustainable development of the present and future generations. The findings of the study show that international law has played a decisive role in intrastate natural resource governance. However, the contemporary international and transnational legislative initiatives adopted address intrastate natural resource governance from a narrowed revenue inflow perspective and left other aspects out of their scope. Also, the study shows that the role of international and transnational legislative initiatives is to complement the existing intrastate legislative and regulatory regimes and frameworks. The study also shows that oil and gas governance in Tanzania is convoluted due to the existence of competing and overlapping legal and regulatory regimes. The regimes are not coordinated and harmonised. The study recommends the harmonisation of the legal regimes and promotion of the international cooperation on exchange of information among states as means of addressing the intrastate natural resource governance challenges.

Internationales Recht hat bei der Entwicklung der Souveranitat uber Bodenschatze und der Bewirtschaftungvon Bodenschatzen im zwischenstaatlichen Verhaltnis eine bedeutende Rolle gespielt. Eswird allerdingsvor dem Hintergrund grenzuberschreitender Investitionen und Rechtsordnungen uberschreitender Kapitelflusse gefordert, internationale Regeln zu erlassen, welche die Aktivitaten multinationaler Unternehmen in Gastlandern regeln. Daruber sind die unkoordinierten und nicht harmonisierten rechtlichen, institutionellen und regulatorischen Rahmenbedingungen fur die Ol- und Gastindustrie in Tansania fur eine schlechte Lenkung dieser Branche verantwortlich. Die vorliegende Arbeit hat das Ziel, die Rolle des internationalen Rechts fur die zwischenstaatliche Bewirtschaftungvon Bodenschatzen zu untersuchen, insbesondere inwieweit dieses zu Verbesserungen in Bezug auf die Bewirtschaftungsschwierigkeiten in den Gastlandern beitragen kann. Die Arbeit untersucht auch die rechtlichen, institutionellen und regulatorischen Fallstricke der Ol- und Gasindustrie in Tansania und die Moglichkeiten, mit denen sie uberwunden werden konnen, um die Forderung von Ol- und Gasvorkommen in einer umweltfreundlichen Weise im Sinne einer nachhaltigen Entwicklung fur diese und kunftige Generationen auszubauen. Die Ergebnisse der Arbeit zeigen, dass internationales Recht bei der zwischenstaatlichen Bewirtschaftung von Bodenschatzen eine entscheidende Rolle gespielt hat. Allerdings gehen die heutzutage verabschiedeteninternationalen und transnationalen Rechtsetzungsinitiativen die zwischenstaatliche Bewirtschaftung von Bodenschatzen aus einer engen, auf Erlose bezogenen Perspektive an und lassen weitere Aspekte auser Betracht. Die Arbeit zeigt auch, dass die Rolle von internationalen und transnationalen Rechtsetzungsinitiativen darin besteht, das bestehende zwischenstaatliche Rechts- und regulatorische Regime und die Rahmenbedingungen zu erganzen. Die Arbeit zeigt zudem auf, dass die Bewirtschaftung von Ol und Gas in Tansania aufgrund der miteinander konkurrierenden und sich uberlappenden bestehenden rechtlichen und regulatorischen Regime unubersichtlich ist. Die Regime sind nicht koordiniert und harmonisiert. Die Arbeit spricht sich fur die Harmonisierung der rechtlichen Regime und fur die Forderung der internationalen Zusammenarbeit in Bezug auf den Informationsaustausch zwischen Staaten als Mittel zur Bewaltigung der Schwierigkeiten der zwischenstaatlichen Bewirtschaftung von Bodenschatzen aus.
