Before China opened its doors to world trade in 1978 and joined the World Trade Organization, the world created global rules and standards without China's input. These rules and standards are now challenging China's innovation and protection schemes. The country has had to play catch up to global standards in many areas including intellectual property rights. This qualitative, exploratory study researches the evolving processes practitioners follow within the Chinese Ministry of Agriculture and Rural Affairs and the State Forestry and Grassland Administration to obtain granted plant breeders' rights, a subcategory of intellectual property rights. The investigator conducted one-on-one semi-structured interviews with ten plant breeders' rights practitioners located around the world. The study sought to uncover some of the avenues the practitioners use to successfully shepherd a plant breeders' right application from filing to granted status in China. This research study revealed some critical concerns for practitioners when working with the Chinese intellectual property systems. These concerns include the substantive examination trials for distinctness, uniformity, and stability, communication particularly with documents available only in Chinese, finding an experienced, reputable, and reliable Chinese agent, and the frustrations around complying with the current vague application-to-grant process. These findings have important implications for how practitioners can efficiently navigate the current emerging plant breeders' rights protocols in China such as taking the time to understand the entire process and remaining engaged and connecting with a global breeders' association.
