Approximately half of marriages in the United States of America end in divorce, straining already overloaded circuit court systems (American Psychological Association, 2016; Killewald, 2016; Yates, Tankersley, & Brace, 2010). Mandated mediation has become a way to reduce the number of backlogged cases, decrease the time to divorce, and provide ivorcing couples increased participation in deciding the outcome and conditions of their divorce settlements for ratification by a judge. If the mediation cannot produce a settlement or clients do not uphold the ratified agreements, the case goes to court for a judicial decision. There have not been many studies that show which factors present or types of cases filed indicate a high or low chance of mediation being successful by reaching and upholding an agreement (Donohue, Sherry, & Idzik, 2016; Engler, 1999; Field, 2016; Pinho & Paumgartten, 2013). Currently, the only identified factor against using mediation is the presence of abuse (Emery, Sbarra, & Grover, 2005; Pinho & Paumgartten, 2013). Interviews were conducted in this exploratory case study to collect the opinions of judges, lawyers, and mediators regarding which factors make court-mandated divorce mediation difficult and the best ways to overcome them. Results can be used to create guidelines that help mediators address how to overcome barriers in difficult divorce cases, as well as influence further study into how divorce mediators, attorneys, and judges can improve mediation success.
