This study addressed the experiences sexual assault victims have with the criminal justice system in the United States (U.S.). The purpose of this basic qualitative study was to understand what aspects of the United States' criminal justice process sexual assault victims focus on when deciding whether to participate at trial. The Network Episode Model served as the framework for the study. This research was conducted with 35 male and female sexual assault victims from 22 states in the U.S. They responded to an open-ended questionnaire designed to elicit narrative responses related to their experiences with the justice system. Specifically, the questionnaire dealt with the aspects of the U.S. justice system that did or did not increase their motivation to participate in the trial process. Responses to the questionnaire were collected and analyzed. Responses were deductively coded into positive (motivational) and negative (de-motivational) experiences. Subcategories emerged from the two primary categories. The subcategories are as follows: Fair/Respectful Treatment by Criminal Justice Personnel, Kept Informed of the Process, Protect Others/Ensure Justice was Done, Support/Compassion/Trust, Disbelief/Judgmental/Dismissive, Negative Treatment by Criminal Justice Personnel/No Trust, Failure to Pursue the Case, Processing Timing is Too Slow, Fear, and Negative Social Impact. The results provided limited information, which policymakers and leaders may consider as they interact with sexual assault victims. More research is needed on this topic.
