The way in which forensic evaluators consider individuals' cultural factors, such as level of acculturation and familiarity with the United States' judicial customs, is an important nuance of adjudicative competence evaluations. However, despite previous research regarding cultural issues and adjudicative competence evaluations, there is currently a dearth of information pertaining to how these cultural issues are actually incorporated into adjudicative competence evaluations. This study was designed to elucidate how the cultural nuances of evaluees' identities are understood and integrated into their adjudicative competence evaluations. The participants of this study (N = 77) were licensed forensic mental health evaluators with professional psychology, psychiatry, education, and/or law backgrounds. All participants were surveyed regarding their opinions on their adjudicative competence practices, and how this differs across defendants who may present with differences in level of acculturation and other cultural attributes. In conclusion, the data yielded that forensic evaluators do consider acculturation and other cultural factors while assessing an evaluee's functional abilities, and find this to be important and frequently considered. Additionally, forensic evaluators who highly value culture are not more likely to assess and integrate cultural considerations into their adjudicative competence evaluations. Further, the level of formal forensic and cultural competence training does not predict the importance or frequency of evaluators assessing for acculturation during adjudicative competence evaluations. Lastly, the importance or value that forensic evaluators place on considering acculturation when assessing an evaluee's rational understanding and ability to consult with their legal counsel does not significantly impact the frequency at which they are assessed.
