The primary subject matter of this dissertation is the modern idea of liberty in the first Iranian Constitution (i.e., the Fundamental Laws ratified in 1906 and its Supplementary finalized in 1907). It seeks to explore the contribution of four leading Iranian intelligentsia---Malkum, Talebov, Akhundzadeh, and Kermani---to the emergence of the modern idea of liberty before its codification in the first Iranian Constitution. It is often believed that the modern idea of liberty (at the core of which are the concepts of the state's legitimacy based on a social contract, political participation through a parliamentarian model of governance, and patriotic loyalty to a national state) was imported from the West. According to this belief, which shall be called exposure theory, in the process of the importation, those who were more exposed to Western political thought and mode of life, such as travelers and intelligentsia, acted as transmitters of knowledge.

The transmission of ideas like constitutionalism, parliamentarianism, separation of power, and modern liberty was amplified during the 19th and 20th centuries, when Iran's economic structure was undergoing a transformation from its use-value to an exchange-value model under the weak state of the Qajars. Nevertheless, a close examination of the primary avenues of exposure to the West, such as travelogues, newspapers, modern education, and anjumans (reading circles), shows that neither the magnitude of the exposure nor the depth of the penetration of Western political thought into the Iranian-Islamic political culture was wide and deep. In the absence of a communicative, expansive, and inclusive public sphere, the imported ideas like modern liberty could not meaningfully permeate into the Iranian social fabric before the ratification of the constitution in 1907. Under these conditions, when economic opportunities were rare and the public sphere slim, the intelligentsia thoughtfully elaborated on two aspects of the modern idea of liberty---selfishness (i.e., legal rights) and selflessness (i.e., pleasant obligations)---but stopped short and did not dig deep enough into a more fundamental concept of self (i.e., unconditional and reciprocal acknowledgment of and respect for selfhood as the basis and reason for freedom). This shortcoming was caused by their philosophical naivete, short-term opportunistic tactics, and particularly anxiously pragmatic ethos that were caused by exposure to foreign imperialism and domestic despotism. Instead, they often for tactical reasons coated modern concepts with an Islamic language and only rhetorically made them compatible with Islamic principles; that is, in effect, exposure to the West resulted in rhetorical Islamicization of European interpretations of liberty.

All in all, more obvious and empirical aspects of the modern idea of liberty, such as political participation in a constitutionalized parliamentarian government, were copied from the West; however, deeper theoretical discussions, such as understanding liberty in terms of selfhood, were neglected, and instead, the concept of liberty was Islamicized without being adequately explored in a meaningful public sphere in which it could be organically vernacularized.
