A census of state oil and gas forced pooling laws was conducted to identify differences between state laws, including how each state's law and policy affects non-consenting owners. Results include variation among states regarding minimum acreage control requirements that must be obtained before forced pooling becomes effective. A temporal analysis compared state non-consenting owner treatment schemes from 1986 and 2012, showing movement by several states away from "free ride" and "silent" schemes towards employing risk penalty provisions or options against non-consenting owners. This suggests states are adapting their laws to better fulfill policy goals of preventing waste, increasing the ultimate recovery of resources, and protecting the correlative rights of the proponents of drilling operations. The information provided in this thesis will aid practitioners, scholars, and individual landowners by providing an analysis of forced pooling laws and updates to the literature in response to the advent of high volume hydraulic fracturing.
