In post-conflict societies it is often asserted that transitional justice should be used to move a society forward and to restore society. In the past, transitional justice has been used in societies that have experienced some sort of conflict, whether through war, genocide, or authoritarian regimes. Building on truth and justice as a means to move a society forward, transitional justice procedures have addressed the human rights abuses that occurred during times of conflict. Today, with the expansion of human rights law there is a newly developed field of abuses emerging in relation to the environment and environmental rights for both human and non-human populations. With conflict becoming a continuous cycle for countries, scholars have pushed transitional justice to include new and more effective ways to transition whole societies. The inclusion of environmental justice in transitional justice procedures provide a unique way to not only address all abuses that have occurred during conflict, but also provide a holistic transition of society and the environment. Current transitional justice procedures have yet to effectively implement this inclusion. Looking at both past and current procedures, one can pinpoint barriers while also viewing potential catalyst for the inclusion of environmental justice in transitional justice.
