While the United States and China are constantly increasing bilateral trade, the copyright/intellectual property protection issue in China remains a top U.S. concern. Although China passed its copyright law and implementation regulations in 1990, legal enforcement presented a big disparity to its trading partner. Researchers generally believed that political emphasis and legal unprofessionalism have caused inefficiency in protection. Economists persuaded China that strong protection enhances economic development. While these studies offered insightful perspectives, I believe the copyright approach of a culture is a complex issue. When we study extensive piracy as a collective behavior, we should take into consideration rhetorical traditions, cultural values and beliefs, as well as the globalization of copyright practice, because these factors shape how a people think, act, and make decisions in the context of copyright protection.

Consequently, the review of the relevant literature situates this project within the discipline of rhetoric and provides a multifaceted framework for the main research question: In what ways do rhetorical and cultural traditions in the U.S. and China and global copyright practice impact understanding and enforcement of copyright in their respective countries and in what ways are these expectations influential in U.S./China professional communication? Using three sets of Western/U.S. and Chinese rhetorical texts, I conduct a comparative study of U.S. and Chinese approaches to copyright practice.

I apply the methods of cluster analysis, intercultural rhetoric/communication, and Marxist criticism to analyze the texts. I focus on key terms, cultural values and beliefs, and major content of U.S.-China bilateral treaties and examine their meanings and implications. Then, I compare and contrast their respective influences on the two cultures' legal and copyright approaches. This inquiry into U.S.-China copyright approaches adds to the knowledge base of copyright practice in different cultures and makes some recommendations for the discipline of Rhetoric and Professional Communication and policy makers.
