American soldiers are returning home from war with serious mental health issues. Many of them are self-medicating with drugs and alcohol to deal with the trauma associated with their experiences. The illegal and legal substances the soldiers are using as a coping mechanism is leading many to commit criminal activities resulting in being arrested and incarcerated. In 2008 Veterans Treatment Court was created to address the American veteran in the criminal justice system. Since its inception, over 100 of these treatment courts have been established throughout the United States to hold the veteran accountable for their criminal activity while providing treatment they otherwise may not seek. This executive position paper examines the history of problem-solving courts, substance abuse and mental illnesses among veterans, and the facts surrounding the incarceration of veterans. This paper further investigates the current operational practices of two jurisdictions with active Veterans Treatment Courts and explores the best practices utilized by courts throughout the country. Finally, this position paper develops operational recommendations for the Delaware Judicial Branch to implement in its Veterans Treatment Court to treat the veterans in its jurisdiction.
