The purpose of this dissertation is to first examine the ethical issues relating to the practice of ovum donations and sales. It will argue that with the appropriate policy, guidelines and regulations, ovum donations are justifiable. It will continue to argue that ovum sales are also justifiable because they adhere to certain ethical principles. The ethical principles that apply to this issue and that give shape to this dissertation are distributive justice, autonomy, confidentiality, beneficence, non-maleficence, privacy, dignity of life and sanctity of life.

520 $a Its approach will first be to clarify the meanings, as they will be used, of the terms "selling" and "donation." Donations imply that the donor freely consents to give her ovum, without coercion, manipulation or undue pressure. She is compensated for her medical and travel expenses, as well as the time she misses from work. "Selling" implies that she not only receives compensation, but is given excessive monetary or other bonuses for specific qualities. Secondly, it will provide the background and current context of the practice of ovum sales and donations. It will look at the ovum selling industry in terms of marketing techniques, pricing practices, fertility clinics involved, current regulations and the demographics of the donors and recipients. Thirdly, the essay will analyze the current debate between advocates and their opposition for ovum sales. Fourthly, it will use the dominant paradigm of James Childress' "principlism" to analyze the issues and make normative ethical judgments about the positive and the negative aspects of ovum sales and donations. "Principlism" in James Childresses' and Tom L. Beauchamp's popular text, Principles of Biomedical Ethics, is the use of four core principles: respect for autonomy; beneficence (including both positive beneficence and utility); nonmaleficence and justice, with several derivative rules especially truthfulness, privacy, confidentiality, fidelity, and respect for the dignity of life and the respect for the sanctity of life. They provide a framework of moral theory for the identification, analysis and resolution of moral problems in medicine. Finally, it will conclude by giving reasons for why selling ova is rational, and then setting a justification for ovum sales.
