Faculty regimes, i.e., the rules, policies, and criteria for faculty selection, appointments, tenure, workload, evaluation, compensation, and participation in governance, are compared across public and private universities in Chile to determine whether the regimes of academic work in private universities are different from those found in the public sector, a question that illuminates the problem of how universities, and more generally, educational organizations, acquire, preserve and change their organizational forms. Data for the study come mainly from interviews of administrators in 12 Chilean universities, carried out in 2002, and also from faculty handbooks and other written material describing or regulating faculty regimes in each institution.

I found that faculty regimes in public and private universities are diverse, and that this diversity is the result of different organizational strategies designed to adapt to a highly competitive environment. Other findings are that (a) faculty regimes in public universities are largely not isomorphic with respect to one another, (b) regimes in private universities are diverse from one another too, (c) some private universities are more similar to public universities that to other privates, and therefore, (d) knowing the juridical status of a university as private or public is not enough to know, even in general terms, the characteristics of its faculty regime.

These findings are consistent with the contingency theory of organizations, and more generally, with rational theories of organizational behavior. They are not supportive of institutional theory, nor do they uphold a population ecology explanation of the patterns of diversity and homogeneity.
