The weakening of pharmaceutical patent protection presents a risk to both pharmaceutical companies and consumers of needed medicines. Although pharmaceutical patent personnel have responsibilities to protect drug development and existing drug investments, researchers have not investigated the patent process from the point of view of pharmaceutical patent employees. The purpose of this qualitative study was to determine the common patent challenges as experienced by pharmaceutical patent personnel and to explore ways in which these employees believed such challenges could be overcome. Fourteen pharmaceutical patent personnel were recruited through the Patent Information User Group and other pharmaceutical company patent contacts. Participants were interviewed using a 17-item survey instrument and open-ended questions. Data was triangulated by means of literature reviews, interviews, and expert responses. Responses were coded and categorized into themes. Seven main challenges to participants in daily work were uncovered: technology, multiple language data, lack of resources, changing regulatory environment of the patent process, nonstandardization of regulations across countries, availability of data, and credibility of data. Seven main challenges to the pharmaceutical industry included the threat of generics, the continuance of the inventive pipeline, litigation, patent protection, a challenging regulatory environment, a competitive environment, and investment decisions. Participants perceived the improved use of technology and tools, the international standardization of regulations, and the increased enforcement of patents by government bodies as potentially helpful for overcoming these challenges. Findings will be of benefit for increasing the productivity of patent personnel by mitigating challenges to protecting drug development. Future research is recommended with government officials of developing countries and with health care professionals to develop stronger patent programs.
