In 2003, the United States Supreme Court decided on two cases that involved affirmative action policies for admission to the University of Michigan at Ann Arbor Law School and the College of Literature, Science and the Arts. Those cases, Gratz v. Bollinger (2003) and Grutter v. Bollinger (2003) had implications for the policies universities and colleges undertook to achieve a diverse student body. The Supreme Court decisions necessitated the need for colleges to review their affirmative action policies to determine compliance with the rulings in the Michigan cases and guidance from the United States Department of Education. This Executive Position Paper is a review of admission and financial aid policy at the University of Delaware to determine compliance and recommendations for any necessary changes.

The policy review involves looking at the changes in practices, and any changes in minority student enrollment, at selected state flagship universities where lawsuits were filed that involved affirmative action policies in admission or financial aid. The University of Michigan at Ann Arbor, the University of Texas at Austin and the University of Maryland at College Park each experienced lawsuits. The Hopwood v. Texas (1994) case involved affirmative action admission policy at the University of Texas Law School. In Podberesky v. Kirwan (1995) the lawsuit involved a scholarship program limited to African American students.

Paper one will look at the history of desegregation, affirmative action and diversity; at the national level and the University of Delaware. Policy changes after lawsuits at selected comparable universities will be covered in paper two. Policy implications for the University of Delaware along with recommendations for changes will be presented in paper three.
