In this dissertation I argue that John Rawls's theory of justice as it stands is unsatisfactory because it is based on the normative assumption that all members of society participate in reciprocal relationships. It therefore fails to address the question of how justice as fairness views the non-reciprocal relationships between competent adults (CAs) and people with cognitive disabilities (PCDs). My task is to show how the theory can be revised and developed to provide a systematic approach that specifies how social institutions should be arranged to accommodate both non-reciprocal and reciprocal relationships. A successfully revised Rawlsian theory must be resourcist rather than welfarist and must provide some principled basis for limiting our obligations to PCDs.

Participating in reciprocal relationships with CAs is the kind of good that is essential to enjoying the rights and liberties distributed by the first principle. Furthermore, providing the conditions necessary for developing reciprocal relationships is a collective good for society, because it enables people to endorse Rawls's Principle of Fairness, and reinforces their commitment to the ideal of reciprocity. I extend Henry Shue's theory of basic rights to claim that preventing deficiencies in the essentials for enjoying political rights is just as basic as preventing violations of physical security or preventing deficiencies in the essentials for physical survival. I argue that everyone has the right to access the conditions necessary for developing the capacities required to understand and exercise the basic rights and liberties. I examine four ways of revising the Rawlsian theory in order to ensure that this right is respected while also giving due concern to the interests of CAs. I conclude by defending a revised version of the Opportunity Principle together with a redefinition of the least advantaged group.
