This is a study of the plural legal system of eighteenth century Mexico. Document-based data from the colonial jurisdiction of Teotitlan del Valle, in the Valley of Oaxaca, was used to analyze the relationship between the Spanish and indigenous legal systems from that time period and to understand how this relationship affected the development of customary law in the towns of the district.

The data revealed that, although the Spanish and indigenous legal systems were theoretically separate, in practice they were thoroughly linked in a complicated, hierarchical arrangement that had repercussions on the indigenous legal system and on the local Spanish courts. The interconnectedness between the two legal systems was established not through institutional links, but through the actions of legal actors, both Spanish and indigenous, who regularly pursued strategies that involved crossing the boundaries between the Spanish and indigenous legal systems.

The jurisdictional fluidity established between the two systems through the legal decision-making of individuals and groups of individuals also played a role in the manipulation and constant recreation of customary law in the indigenous villages. In their efforts to exclude others from access to power, the indigenous elites used customary law as a source of justification for exclusivity. Conversely, the indigenous non-elites used customary law as a source of justification for inclusivity in their attempts to gain access to that same power. Both groups manipulated and re-imagined customary law in pursuit of their goals and turned to the Spanish legal system to adjudicate conflicting interpretations of that law, effectively granting the Spanish courts a role in the creation of customary law.
