In May of 1787, delegates gathered at a convention in Philadelphia to discuss problems of government under the Articles of Confederation. They believed in republican principles of government, which rest firmly on the concept of majority rule. The challenge of infusing a new government with such principles, while also providing protection for individual rights, and particularly rights with respect to property, was a key concern for these delegates. Their response to this challenge substantially impacted the resulting American constitutional framework.

This study examines the role property rights played at the Constitutional Convention, and suggests that compromises achieved in this area enhanced the autonomy of individuals as American government began to unfold. This requires analysis of the Convention's historical context and an examination of prominent participants, such as James Madison. The balance achieved on issues related to property rights is examined and defended as appropriate at its time in history.
