The scope of this study was limited to music education. Resources used to identify court cases involving music educators included electronic databases from collegiate and legal libraries. The most prominent legal issues affecting music educators were determined by court cases that involved music educators and demonstrated that plaintiffs alleged a violation of their rights according to local, state or federal law. A thorough study of historical and contemporary court cases was necessary to reveal the cases that apply to these parameters. Only those cases having precedential value and related to music educators or affecting music educators were included in this study.

Following a discovery of relevant court cases pertinent to music educators, the researcher found prominent cases related to the First, Fourth, and Fourteenth Amendments of the Constitution of the United States. Additionally, prominent cases and government legislation related to negligence issues and business practices of music educators were found that elucidated legal issues about which music educators must be aware. Included in this study also is a discussion of the implications that these findings have for preparing music educators for professional careers.

Findings revealed that music educators operating in the classroom and music educators in training should be aware of legal issues and precedents while performing professional duties. Music educators who have become embroiled in legal controversy, and those who have been named as defendants in lawsuits found that the legal system in the United States demands accountability for their actions. In addition, music educators should consider the affects of entanglement with legal proceedings on their personal lives.
