本書由上、中、下三篇組成。在這三部份中，上篇“民事訴訟制度的透視與變革”是民事司法現代化的重心。我國1991年頒行的《民事訴訟法》雖然比《民事訴訟法（試行）》有了很大的進步，但由於其修改在理論上準備不夠充份，對理論和實踐中的問題也未進行更深入的探討，加上當時國家尚處於計劃經濟時期，使得其在頒布實施不久便暴露出許多問題，不能適應市場經濟對訴訟制度的要求。
