The present study examined the impact of neuroimaging evidence on juror decisions in a capital trial. Mock jurors (N = 257) were randomly assigned to one of eight conditions varied by neuroimaging (present or absent), area of neuroanatomical damage (prefrontal cortex [PFC] or limbic), and obviousness of damage (obvious or non-obvious), then asked to provide a sentencing recommendation (life imprisonment or death penalty) and rate their impressions of the defendant. Hypotheses were informed by the story model of jury decision-making, theories of the power of visual images, and research on the cognitive demand of death. Relationships between jurors' punishment orientations and legal decisions were also investigated. Results suggest that obviousness and area of damage impact juror decisions; however, neuroimages appear to have minimal independent effect. This study contributes to a growing understanding of how neuroimaging variables influence jurors' perceptions and punishment of a capital defendant with brain damage. Overall, the present study has important practical implications for legal professionals and society at large.
