China's intellectual property has long been controversial. Dr. Arpad Bogsch, a former Director General of WIPO, praised that it had developed to where it is today in such a short time. On the other hand, the Donald Trump government has accused China of insufficient intellectual property protection, causing problems such as theft of intellectual property. This paper analyses the advantages and disadvantages of infringements through Michael Jordan's Case and Pinduoduo's counterfeits. Based on the analysis, this paper also takes a broad view of the Chinese market and attempts to explain the following concerns: the reasons why there has been so many infringements in China, how to improve the situation and the expectable trend on this regard in the near future.

A propriedade intelectual na China tem constituido um assunto controverso. Neste contexto, o Dr. Arpad Bogsch, ex-Diretor-Geral da WIPO, elogiou o progresso que a China registou nesta materia num curto espaco de tempo. Simultaneamente, o governo Donald Trump acusou a China de protecao insuficiente a propriedade intelectual, causando problemas designadamente com apropriacoes indevidas de propriedade intelectual. Este trabalho analisa especificamente infracoes a propriedade intelectual na China atraves do estudo do "Caso Michael Jordan" e do caso das falsificacoes de Pinduoduo. Tomando como referencia estes dois casos, tentou-se alcancar uma visao ampla do mercado chines, de forma a responder as seguintes preocupacoes: porque se tem verificado tantas infracoes na China; como melhorar a situacao; e qual a a tendencia esperada nesta materia num futuro proximo.
