2021 年 3 月，《中華人民共和國國民經濟和社會發展第十四個五年規劃和 2035 年遠景目標綱要》出臺，為我國未來五年的經濟和社會發展奠定基調和方向。《"十四五"規劃綱要》提出構建以國內大循環為主體、國內國際雙迴圈相互促進的新型發展格局，並在此願景下提出促進區域協調發展、積極穩妥推進粵港澳大灣區建設、建設高水準開放型經濟體的目標。在《"十四五"規劃綱要》的指引下，《橫琴粵澳深度合作區建設總體方案》同年 9 月出臺。《總體方案》提出由粵澳雙方共商共建共管橫琴深度合作區，在合作區打造與澳門一體化高水準開放的新體系，支持澳門更好融入國家發展大局。《總體方案》在"十四五"開局之年落地，既是落實規劃綱要目標的必要步驟，也是堅持和發展"一國兩制"實踐、支持澳門更好融入國家發展大局的重要舉措。《總體方案》因此應在兩個維度下解讀：一是從國家雙迴圈發展格局下理解深合區建設在我國區域協調發展和制度型開放中的戰略意義，二是在 "一國兩制"的基本國策下理解深合區建設對保持特別行政區繁榮穩定、支持特別行政區融入國家發展大局的革新意義。本文以問題為導向，從理論和實踐兩個維度，從行政、立法、和糾紛解決三個方面對深合區的法治創新進行可行性研究。文章提出，在深合區法制構建中，首先要從國家法治的維度思考區域法治的目標，並結合粵澳跨境區際合作模式在《憲法》與《基本法》的框架下為深合區法制構建做好頂層設計。其次，在"依法行政"的要求下，深合區及其管理機構法律地位的明確，是粵澳府際合作合法性的前提。在粵澳合作的過程中，應遵守平等互惠、透明彈性、風險預防和國家利益的法律原則，以突出和回應"一國兩制"下一般行政區和特別行政區之間跨境府際合作特點。在深合區法制建構方面，應充分發揮珠海市特區立法的"變通權"，以實際需要出發，多途徑多手段的銜接琴澳民商事規則。同時，在深合區應綜合運用仲裁、調解等多元化糾紛解決機制促進粵澳兩地法律環境的融合。

520 $a In March 2021, the 14th five year plan for national economic and social development of the people's Republic of China and the outline of long-term objectives for 2035 were issued, laying the accordatura and direction for China's economic and social development in the next five years. The outline of the 14th five year plan proposes to build a new development pattern of "dual circulation," in which domestic and foreign markets reinforce each other, with the domestic market as the mainstay. Under this vision, it puts forward the objectives of promoting regional coordinated development, actively and steadily promoting the construction of Guangdong Hong Kong Macao Great Bay area and building a high-level open economy. Under the guidance of the outline of the 14th five year plan, the overall plan for the construction of Hengqin Guangdong Macao in-depth cooperation zone was issued in September of the same year. The overall plan proposes that Guangdong and Macao should jointly build and jointly manage the Hengqin in-depth cooperation zone, create a new system of high-level integration and opening-up economy with Macao in the cooperation zone, and support Macao to better integrate into the overall development of the national development.The implementation of the overall plan in the first year of the 14th five year plan is not only a necessary step to implement the objectives of the outline of the plan, but also an important measure to adhere to and develop the practice of "one country, two systems" policy and support Macao's better integration into the overall development of national development. Therefore, the overall plan should be interpreted in two dimensions: one is to understand the strategic significance of the construction of the Hengqin in-depth cooperation zone in China's regional coordinated development and institutional opening-up under the national dual circulation development pattern; the other is to understand the innovative significance of the construction of Hengqin indepth cooperation zone in maintaining the prosperity and stability of the Special Administrative Region and supporting the integration of the special administrative region into the overall development of national development under the basic national policy of "one country, two systems".This paper is problem oriented, and based on the research of both the theory and the practice dimensions. It makes a feasibility study on the innovation of the rule of law in Hengqin in-depth cooperation zone from the perspectives of the legitimate use of its administrative power, legislative power and judicial power. The article proposes that in the construction of the legal system of the Hengqin in-depth cooperation zone, we should fix the goal of the regional rule of law from the dimension of the national rule of law, and make a top-level design for the construction of the legal system of the Hengqin in-depth cooperation zone under the framework of the Constitution and the Macao Basic Law in combination with the special cross-border interregional cooperation mode between Guangdong and Macao. Secondly, under the requirement of "administration by law", the clarification of the legal status of Hengqin in-depth cooperation zone and its management organization is the premise of the legitimacy of Guangdong Macao intergovernmental cooperation. In the process of administrative cooperation, we should abide by the legal principles of equality and mutual benefit, transparency and flexibility, risk prevention and national interests, so as to highlight and respond to the characteristics of cross-border intergovernmental cooperation between general administrative regions and special administrative regions under "one country, two systems". In terms of rulemaking, we should give full play to the "flexibility" of the legislation of Zhuhai Special Economic Zone and link up the civil and commercial rules of Hengqin and Macao in multiple ways and means according to the actual needs. At the same time, we should comprehensively use diversified dispute resolution mechanisms such as arbitration and mediation Macao in the Hengqin in-depth cooperation zone to promote the integration of the legal environment between Guangdong and Macao.
