This thesis attempts to identify, analyze, and explore transnational corporations' civil liability issues for environmental damage in developing countries through a systematic approach. Specifically, it seeks to search and answer the following question: what are the causality and solution to an increasing number of transnational environmental tort disputes relating to environmental damage caused by transnational corporations in developing countries. And relevant analysis is mainly structured through a systematic approach.The study is mainly presented in two parts: causality analysis and solution exploration. Part I contains analyses of the causality of environmental damage caused by transnational corporations in developing countries and the difficulty of dealing with transnational corporations' relevant civil liability issues. It is argued that influencing factors behind transnational corporations' civil liability for environmental damage can be divided into economic ones, legislative ones, and judicial ones, and all these factors influence each other and play essential roles together. Part II represents a thorough analysis of possible solutions to problems concluded in Part I. It is demonstrated that proposed suggestions for economy, legislation, and judiciary would take effects from two perspectives: reducing the risks of human-made environmental disasters caused by transnational corporations and providing sufficient remedies once there are relevant ecological disasters.Finally, through a systematic analysis of laying the economic foundation, reducingthe legislative gap, and crossing the judicial borders, the thesis attempts to propose a better framework for opening the way to deal with transnational corporations' civil liability issues for environmental damage in developing countries. It is proposed that further improvements may be possible based on the following changes in the strategy: transnational corporations from pursuing profit maximization to fulfilling social responsibility; legislative authorities from insisting on limited liability principle to establishing stringent environmental regulations; judicial authorities from widely applying forum non conveniens doctrines to reconsidering relevant jurisdiction doctrines.
