With the advancement of digital technology and computers, it was inevitable for warfare to migrate to cyberspace. Laws and policies governing how war is defined and addressed are unable to evolve quickly, but under the International Humanitarian Laws (IHL) it is possible to categorize a cyber-attack as an act of war. The IHL defines an act of war as an event which results in damage to property or death or injury to civilians. These stipulations are most likely to be met when a cyber-attack occurs against critical infrastructure, such as a power grid. This study will show that a cyber-attack against a power grid is capable of meeting the current definition of an act of war. With this knowledge it will be possible for nations to take action against cyber-attacks under specific conditions. This knowledge can be used to create frameworks or further legislation to better define cyberwarfare.
