With the progression and spread of information technologies, personal information is being used innovatively to increase individual, social, and economic benefit. At the same time, the risk of invasion of privacy has also grown higher. Currently, at international governmental meetings, many countries insist on the importance of comparing legal systems protecting privacy for the development of international economic society. This thesis aims to identify similarities and differences in Canadian and Japanese laws concerning the protection of privacy and personal information in the private sector. It also intends to shed light on the reasons for these similarities and differences, through investigation of the legislative history, judicial precedents and records in legislative procedure.First, this thesis considers the origin and development of the "right of privacy" and personal information protection. It identifies the privacy protected by tort law, constitutional law and data law and defines the meaning of the right of privacy. Second, the thesis will inquire into the process of developing privacy and personal information protection in Canada and Japan. This thesis suggests that the process of developing privacy and personal information protection in both Canada and Japan is divided into five periods. Finally, the thesis will engage in an in-depth comparison of the personal information protection laws between Canada and Japan, the Personal Information Protection and Electronic Documents Act (PIPEDA) of Canada and the Act on the Protection of Personal Information (APPI) of Japan. The comparison will focus on three criteria: 1) what are the laws concerning personal information protection supposed to protect, 2) how do the laws protect personal information, and 3) what mechanisms guarantee the actual enforcement of the laws. A few of the most striking differences identified are the way in which the respective legislation deals with anonymously processed information, the consent principle, the opt-out procedure, and the settlement of complaints by accredited personal information protection organizations. Various reasons for these differences are suggested, and include the economic structure, intention of government, and legal framework in each country.

Avec la progression et la diffusion des technologies de l'information, les informations personnelles sont utilisees de maniere innovante pour accroitre les avantages individuels, sociaux et economiques. En meme temps, le risque d'atteinte a la vie privee a egalement augmente. Actuellement, lors de reunions gouvernementales internationales, de nombreux pays insistent sur l'importance de comparer les systemes juridiques de protection de la vie privee pour le developpement de la societe economique internationale. Cette these vise a identifier les similitudes et les differences dans les lois canadiennes et japonaises concernant la protection de la vie privee et des renseignements personnels dans le secteur prive. Elle vise egalement a faire la lumiere sur les raisons de ces similitudes et differences, par le biais d'une enquete sur l'historique legislatif, les precedents judiciaires et les archives de la procedure legislative.Premierement, cette these considere l'origine et le developpement du « droit a la vie privee » et la protection des informations personnelles. Elle identifie les aspects de la vie privee protegee par le droit des biens, le droit de la responsabilite, le droit constitutionnel et le droit des donnees, et definit le sens du droit a la vie privee. Deuxiemement, la these examinera le processus de developpement de la protection de la vie privee et des informations personnelles au Canada et au Japon. Cette these suggere que le processus de developpement de la protection de la vie privee et des informations personnelles au Canada et au Japon est divise en cinq periodes. Finalement, la these proposera une comparaison approfondie des lois sur la protection des informations personnelles entre le Canada et le Japon, la Loi sur la protection des renseignements personnels et les documents electroniques du Canada et la Loi sur la protection des informations personnelles du Japon. La comparaison se concentrera sur trois criteres: 1) Qu'est-ce que les lois (concernant la protection des informations personnelles) sont censees proteger? 2) Comment les lois protegent-elles les informations personnelles? et 3) Quels mecanismes garantissent l'application effective des lois. Quelques-unes des differences identifiees les plus frappantes sont la maniere dont la legislation respective traite les informations traitees de maniere anonyme, le principe du consentement, la procedure de desabonnement et le reglement des plaintes par des organisations de protection des informations personnelles accreditees. Diverses raisons expliquant ces differences sont suggerees, notamment la structure economique, l'intention du gouvernement et le cadre juridique de chaque pays.
