The National Registry of Exonerations (NRE) indicates that official misconduct is the second highest contributing factor in wrongful convictions. As of November 2019, 1,355 cases of the total 2,519 exonerations recognized by the NRE are due to official misconduct. The definition of the term "official" is recognized in state statutes in different capacities, as well as the existence of varying forms of discipline for perpetrators of official misconduct within the United States. Previous studies have indicated misconduct as a contributor to wrongful convictions, particularly lack of accountability for criminal justice professionals. In this study, the nature and extent of U.S. official misconduct statutes are explored. This includes a content analysis on how states define officials, four term categories (intentionality, benefits, harm, and unauthorized), and punishments for violations of official misconduct. Findings of the study showed a lack of standardization in themes of the terms analyzed, which reinforce the composition of a model statute based on the findings. This analysis concludes that there is a need for further research on state legislation and policy reform on official misconduct, particularly as it pertains to wrongful convictions.
