Yet, questions remain as to how successfully the FOIA has been carried out. This study, for the first time ever, has built a database of FOIA use and implementation since federal departments and agencies were first required to submit annual reports. Since 1975, all departments and agencies subject to the FOIA have been required to submit these annual reports to Congress. The reports provide data on FOIA activity and agency compliance, including figures on requests, denials, exemption claims, appeals, delays, other authorities for unsuccessful requests among other wide and changing categories of information. In acquiring the cabinet-level FOIA annual reports from 1975 until 2014, through proactively disclosed reports, individual FOIA requests to the departments and a visit to the National Archives, the study has aggregated over 90 percent of the population of annual reports for cabinet-level departments.

Along with providing a history and theoretical underpinnings of the FOIA, the study analyzes 40 years of use and implementation data, comparing trends and disruptions against the judicial, legislative and executive record. The study documents with empirical support noteworthy patterns among known problem areas like the law enforcement exemption, the privacy exemption and delays, while also staking new statistical observations on costs and fees, appeals and closures under other authorities. Ultimately, the study highlights the successes, failures, insincerity and lack of financial support in dispatching what President Obama has called "the most prominent expression of a profound national commitment to ensuring open Government.".
