To address the grave danger in America after 9/11, President George W. Bush and Congress enacted sweeping legislation known commonly known as the Patriot Act. Although much is known about the public policies to safeguard Americans, little is known about the Patriot Act's effects on African Americans. Previous research suggests that a small percentage of African Americans believed they were unfairly targeted and mistreated as a consequence of this legislation and anecdotal evidence suggests violations of civil liberties and rights. This phenomenological study explored the perceptions and lived experiences of 12 African Americans age 18 and older with regard to the Patriot Act of 2001 to better understand the unintended consequences of the law on their daily lives. The theoretical framework of the study was Kingsley's theory of bureaucratic representation. Data were collected with structured interviews and analyzed via Moustakas's modification of Van Kaam's method. Three main themes emerged of African Americans' experiences: (a) that the Patriot Act invaded their privacy; (b) that their lack of local government involvement impacted this legislation development on a larger scale, and; (c) that the Patriot Act's influence stemmed from ethnic profiling, which obstructed their personal lives. The present study promotes positive social change by providing insight to communities and policymakers about unintended consequences of the Patriot Act on African Americans so that more inclusive and democratic public policies can be crafted.
