This research explores the complex linkages between research and development (R&D) in agricultural biotechnology, intellectual property protection (IPP), and agribusiness strategy in the United States. The link between effective IPP in agricultural biotechnology and investment in R&D is addressed from both a theoretical and empirical perspective. The same approach is used to investigate the market structure and the agribusiness strategy most conducive to investment in R&D. The research includes and extensive review of previous studies on agricultural biotechnology issues, public policy related to investment in R&D and IPP, and case studies on agribusiness strategic partnering. The overall purpose is simple. The results obtained from the United States agricultural biotechnology industry may provide insights to help build a more efficient intellectual property system in Mexico and design public policies to encourage innovation and competition. Practitioners and academicians also benefit from this study.

The study uses a panel data with information on 676 publicly held companies operating in the agricultural biotechnology industry in the United States from 1969 to 2000. Model building, model estimation, data analysis, and case studies are used to test the following hypotheses: (1) there is a positive significant effect of IPP on investment in agricultural biotechnology R&D, (2) large firms spend more in R&D than small firms, (3) IPRs result in an oligopolistic structure of the agricultural biotechnology industry, and (4) agricultural biotechnology companies engage in strategic partnering to advance innovation. Two linear models of investment demand in R&D are built and tested. The Herfindahl-Hirschman index of industry concentration is estimated annually to account for changes in market structure. The case studies of actual cooperation agreements between major agricultural biotechnology companies identify the agribusiness strategies used to advance innovation.

Theoretical and empirical results indicate that IPP effectively stimulates investment in agricultural biotechnology R&D. However, there is no conclusive answer as to the market structure most conducive to R&D. No empirical evidence of concentration in the agricultural biotechnology industry was found. Agribusiness strategies identified include strategic partnering, contracting, or vertical integration involving equity investment, research joint ventures, licensing, technology sharing, mergers, and other forms of cooperative R&D.
