"Epic and Law" examines legal terms and legal scenes in heroic poetry in several Germanic languages (Old English, Old Saxon, Old High German, and Middle High German) as well as in Old Spanish, which is related to these through its Visigothic inheritance, and through its contact with the rest of Europe. This study compares the literary texts Beowulf, the Heliand, the Hildebrandslied, Kudrun, the Nibelungenlied, the Poem of the Cid, the Poem of Fernan Gonzalez, and the Romancero Viejo to the language of the contemporary law codes of England, Germany, and Spain and other extra-literary information about Germanic law to demonstrate the close relation of law and literature in Germanic epic poetry. Germanic epic poetry is inherently juridical insofar as it, by the nature of the genre, aims to justify a certain polity. What would be commonly understood legal culture among Anglo-Saxon, Frankish or other early audiences is lost on modern readers who are not educated in legal anthropology. This study aims to fulfill this need. Moreover, the study of law in relation to other cultural phenomena is especially relevant today, given the developments in Western and International law, including the dissolution of presuppositions which have formed the basis of Western law since the Middle Ages. Legal anthropology is the primary extra-literary, theoretical discipline used in the formulation of this argument. Issues of jurisdiction, dispute settlement, criminality, justice, and legal identity characterize this dissertation.

This study reaches two conclusions. The first is that epic literature is part of the cultural project of justifying a certain legal order. That is, law stands behind epic literature. Moreover, violence stands behind law. The second conclusion is that the epic literature of Spain can be considered part of the same culture we call Germanic in England, Germany, and the rest of Western Europe. Whether or not we can produce the manuscript stemme or provide the genetic relations to prove this, the earliest Spanish epic belongs to the same syncretic, feudal culture that grew up in the rest of Western Europe.
