In 1571, England's parliament passed a bankruptcy act that deliberately included women. This statute constituted the culmination of economic and social pressures, and the beginning of a new legal definition for the women trading in England's markets during the early modern period.

The first chapter of this work examines the place of these women within the larger context of sixteenth century society as well as twentieth century historiography. The second focuses on the larger economic forces at work which directly necessitated the passage of such a bill into law. The third chapter of this thesis looks directly at the supporting case law. The final chapter provides summary analysis and speculation into the larger ramifications of this study. In the end, this thesis explores the impact of economic necessity upon the legal concept of women traders in an otherwise tradition-driven era.
