In recent times, judges and other officials of the Canadian state have engaged themselves in the colonization and management of civil society. This essay critiques this emerging trend and offers a normative view of the relationship, in liberal states, between law, the state and civil society. It is proposed that this relationship subsists mainly in the separation of the state from civil society and deference by the state to the institutions, traditions and practices of an independent civil society, save where interference is necessary to prevent and punish the infringement of individual rights. It is argued that this proposition is embodied in a liberal view of civil society and coincides with principles integral to liberal political morality including the rule of law and separation of powers. In support of this argument, much of the essay elaborates on the liberal understanding of civil society and political morality and the connection between them.
