The existing American public school system is in many ways a living institution that was animated and empowered by the evolution of the state and federal law (Campbell, Cunningham, Nystrand, & Usdan, 1980, pp. 48 & 71). These laws and codes that constructed American educational institutions, (from the local school site to the United States Department of Education), were constructed via a complex historical legal process. This thought was brewing in the American middle and upper class social milieu and legal-language-soup, since the establishment of the first colonies in the East Coast of North America. A thread of diverse thought runs through law enactment, relating directly and indirectly to education. It could be woven upon an unconscious continuum of thought that existed between and within the development of three western master metaphors termed theater, soul, and body. The main purpose of this study was to examine whether the three master metaphors of theater, soul, and body had their seminal roots in the work of Greek philosophers such as Plato and Aristotle. Also to see if they appeared in documents of the American public school system as it became more than just an in loco parentis within the family unit, but also an in loco parentis within the governmental institution. These master metaphors appear in documents in the development of educational codes at the state and federal level. A specific time frame for an early example of an application of these metaphors into a school system was the establishment of the first American public school system in the state of Massachusetts. This process in the state of Massachusetts was overseen by the almost solo work of Horace Mann, in his "Twelve Annual Reports to the Massachusetts Board of Education."
