This study presents a historical account of the various justifications offered both for and against patent monopolies, examines ideological influences that led pro-patent and anti-patent economists to profess their doctrines, and analyzes the early rationale of patent rights in the changing environment for inventions. Specifically, it demonstrates the existence of three early pro-patent approaches: the English, Continental, and American approaches.Subjects--Topical Terms:

520 $a The English approach called for protection in the name of fairness to secure the inventor his just reward. The Continental approach maintained that a man's own ideas are his natural property right. Society must recognize and protect these rights. The American approach averred that industrial progress cannot be obtained if inventors keep inventions secret. Therefore, the most effective way for society to secure these inventions is to grant patent rights. Each justification offered for patent rights by earlier economists promoted inventions and balanced interests between individual inventors and the welfare of society.
520 $a Anti-patent economists disagreed. Some believed that technical advance is serendipitous and felt that patents involve all costs and no gains. Others believed that patents, like tariffs, restrict competition.
520 $a The changes in economic environment in recent years, however, have redefined the role of inventors, and the nature of their motivation. Inventive activities, for the most part, have moved from individual inventors to government and corporate research and development laboratories. While research in corporations is financed for profit, the U.S. government expenditures on research and development are motivated primarily by national prestige and security considerations. Patents, nevertheless, remain important for individual inventors and small corporations to encourage inventions and information revelation.
