The urgency of responding to development needs is paramount when the subject of development accounts for only five per cent of the world's population but make- up for fifteen per cent of the poorest of the world (State of the World's Indigenous population, 2009). How does a nation-state address the development needs of indigenous peoples when their locales are also the targets of development? The purpose of this study is to investigate the results when nation-states allow indigenous peoples to use their own indigenous governing systems to determine their own forms of development.

The passage of the 1997 Indigenous Peoples Rights Act in the Philippines grants indigenous peoples the rights to self-determination in their ancestral domains and mandates the FPIC from indigenous peoples whose ancestral domains are affected by proposed development plans. The traditional leadership and indigenous decision-making processes used by indigenous peoples to reach a consensus to accept or reject the plans and to negotiate development projects with proponent companies. This study attempts to answer how the FPIC process integrates indigenous governing systems and to investigate if a relationship exists between the types of indigenous governing systems and the development projects emphasized by indigenous peoples during their negotiations with proponent companies.

This is a single country case study of a matched sample group. The integration of the indigenous governing systems into the FPIC process and the types of development projects emphasized by the communities were compared using the reports of the NCIP provincial offices as data source. Results show that the data leadership system of the Mandaya of Compostela Valley province is correlated with a combination of negotiated projects that includes economic, social and cultural aspects of development while the tongtong or community-based assembly of the Kankanaey of Benguet province resulted in projects that focused more on one aspect of development.

The results indicate that the free, prior and informed consent process is an important tool for sustainable development to occur but policy change is also recommended to address the possibility of indigenous governing systems affecting the selection of development projects.
