Thesis (LL.M.)--York University (Canada), 2010.
This thesis analyzes the nub of liability underlying the tort of inducing breach of contract, through an examination of its application in the context of employment Jaw. It argues that the very classification "tort", suggests that this tort ought to be concerned with an Inducer's conduct that can be castigated. In support of this proposition, it puts forward the "conduct-centered theory of liability", which argues that in concentrating on the complainant's contractual rights, the courts ignore the Inducer's wrongdoing. In addition, it evaluates the tort of causing loss by unlawful means and the general doctrine of inducement and distinguishes their parameters and application, from the tort of inducing breach.
