For almost two decades the Thai government's attempts to improve the management of migrant workers arriving from neighbor countries have consistently been ineffective. The registration program, as the main policy tool, has produced wide gaps between policy goals and outcomes. Policy gaps have characterized Thailand's effort to control migrant workers. Utilizing international immigration control literature, this study seeks to explain why policy gaps have persisted in Thailand migrant worker policies. This study focuses primarily on Burmese migrant workers since they have been one of the largest groups of migrant workers in Thai history.

This study explores qualitatively the main actors in migrant worker policies, including the roles of government agencies, business actors, NGOs and academics. To provide a better understanding of the policy gaps, this study systematically analyzes these actors' roles throughout the whole policy process--from policy formulation to implementation.

This study finds that the policy gaps in the Thai case can be explained by three main factors. The first factor is macro-structural. The strong demand for cheap migrant workers domestically, the abundant supply of migrant workers from neighboring countries and the undermining effect of the alternate corrupted system have made the policies to control migrant workers virtually ineffective. Second, policy gaps occur as a result of ineffective and ambiguous registration programs. The registration program's main flaws include inflexibility, a lack of cooperation from employers and a lack of strong law enforcement against unregistered workers. Ambiguous policy intentions can be illustrated both at the policymaking level and the implementation stage. Lastly, policy gaps occur due to business actors' abilities to influence migrant worker policies throughout the policy process.

These findings have important implications for the future development of Thailand's migrant worker policies. The collusion between corrupt officials and labor smugglers and brokers, which has created an alternate, corrupt system, should be eliminated in order to establish an effective migrant worker management system. The influence of business actors must be monitored and limited because these actors can undermine migrant worker policies at both the policy formulation and implementation stages.
