Thesis (LL.M.)--University of Toronto (Canada), 2008.
Social network sites (SNSs) represent a new venue for social interaction as well as a new source of concerns for privacy. This thesis explores the privacy implications of SNSs and identifies the difficulties of traditional privacy discourse to capture their unique challenges. It argues that it may be time to rethink traditional privacy law in order to accommodate privacy interests in online conduct and emphasizes the relevance of identity-based accounts of privacy. It also considers the application of data protection law in light of Lindqvist, the first decision to interpret the European Data Protection Directive 95/46/EC in the context of the Internet. It argues that what Lindqvist suggests is that the privacy interest of individuals in controlling their 'digital identity' should not be ignored in the age of new communication technologies.
